By using our website or placing an order, you agree to these Terms. Nothing in these Terms limits or excludes any statutory consumer rights that cannot legally be limited or excluded.
1. About LCNMafiaHistory
LCNMafiaHistory sells physical print-on-demand products featuring standard designs and may also offer products that can be personalised or made to a customer's specifications.
Personalisation may include customer-selected names, wording, dates, images or other details where those options are offered on the relevant product page.
We do not currently offer digital downloads or subscriptions.
Our products are manufactured and fulfilled after ordering through Printify and its production partners.
2. Eligibility and customer information
You must be at least 18 years old to place an order, or have the permission and supervision of a parent or legal guardian.
You must provide accurate, complete and current information when placing an order or creating an account.
You are responsible for checking your order details, including your delivery address and any personalisation information, before submitting your order.
3. Products
We take reasonable care to describe and display our products accurately.
However, some minor differences may occur, including:
- Colours appearing differently because of screen or device settings.
- Small variations in print placement, dimensions, finish or other characteristics caused by normal print-on-demand production.
- Minor differences from product mock-ups where reasonably unavoidable in the manufacturing process.
- Product measurements being approximate unless expressly stated otherwise.
These reasonable variations do not affect your statutory right to receive goods that are as described, of satisfactory quality, fit for purpose where applicable, and otherwise conform to the contract.
We may change or discontinue products at any time, but this will not affect orders that we have already accepted.
4. Personalised and custom-made products
Some products may allow you to provide names, words, dates, images or other information to create a personalised product.
You are responsible for checking that personalisation information supplied by you is accurate before submitting your order.
Where reasonably possible, please contact us immediately if you discover an error after placing your order. Because production may begin shortly after ordering, we cannot guarantee that personalisation details can be changed once production has started.
We reserve the right to refuse personalisation content that is unlawful, infringes another person's rights, or that we reasonably believe we are not permitted to reproduce.
Where a product is genuinely made to your specifications or clearly personalised, the normal statutory change-of-mind cancellation right may not apply where permitted by law. Where this exception applies, it will be made clear before you place your order.
The personalisation exception does not affect your statutory rights if the product is faulty, damaged, incorrect, not as described, or does not match personalisation information that you supplied and we accepted.
5. Prices, taxes and delivery charges
Prices are displayed in the currency shown on the website.
Prices and any applicable taxes will be shown before you place your order.
Delivery charges will be displayed or calculated before you submit your order.
For international orders, the destination country may impose import VAT, customs duties, clearance charges or other local taxes. Unless checkout expressly states that these charges are included or prepaid, you may be responsible for them.
We may correct genuine pricing or product-information errors. If an error affects an order that you have submitted, we will contact you where appropriate or cancel the affected order and refund any amount already paid.
6. Orders and contract formation
Submitting an order through our website constitutes an offer by you to purchase the products in that order.
An automatic order-received or order-confirmation message acknowledges that we have received your order. It does not necessarily mean that we have accepted your offer.
A contract between you and LCNMafiaHistory is formed when we accept your order.
We may decline an order where there is a legitimate reason to do so, including where:
- A product is unavailable.
- We cannot fulfil the requested personalisation.
- There is an obvious pricing or product-information error.
- Payment cannot be authorised.
- We cannot deliver to the supplied address.
- We reasonably believe the order or requested personalisation is unlawful or infringes third-party rights.
If we decline or cancel an order after payment has been taken, we will refund the amount due to you.
7. Made-to-order production
Our products are made to order. Production may therefore begin shortly after an order is received.
This applies to both standard-design products and personalised products.
Production and dispatch estimates are estimates only unless we expressly agree otherwise. Production times may be affected by the product, personalisation requirements, production capacity or other circumstances.
Any applicable statutory cancellation rights are not removed merely because production has begun. However, different cancellation rules may apply to goods that are genuinely made to your specifications or clearly personalised.
8. Cancellation, returns and refunds
Your rights to cancel an order, return goods and receive a refund are explained in our Refund Policy, available at /policies/refund-policy.
For UK consumers, non-personalised goods purchased online will generally carry statutory cancellation rights, subject to applicable exceptions.
Goods that are made to your specifications or clearly personalised may be excluded from the normal change-of-mind cancellation right where permitted by law.
Nothing in this section affects your statutory rights where goods are faulty, damaged, incorrect or not as described.
9. Delivery
Our delivery arrangements are explained in our Shipping Policy, available at /policies/shipping-policy.
Available delivery methods, charges and estimated delivery times will be displayed or calculated where applicable before you complete your order.
Delivery estimates are not guaranteed unless we expressly state that a particular delivery date is guaranteed.
For UK consumer orders, unless another delivery period has been agreed, we will deliver the goods without undue delay and within the period required by applicable law.
Events outside our reasonable control may affect production or delivery. Where a material delay occurs, we will take reasonable steps to keep you informed and provide any remedies required by law.
10. Delivery address
You are responsible for providing a complete and accurate delivery address.
If you discover an error, contact us immediately at LCNMafiaHistory@gmail.com.
Because production and fulfilment may begin shortly after an order is placed, we cannot guarantee that an address can be changed after submission.
If an order is returned because an address supplied by you was incorrect or incomplete, or because the parcel was refused or not collected, we may require payment of reasonable redelivery costs where permitted by law.
11. Risk in the goods
For consumer orders, risk in the goods generally passes to you when the goods come into your physical possession or into the physical possession of a person that you have identified to receive them.
This does not affect your rights where goods are lost or damaged before risk has passed to you.
12. Faulty or misdescribed goods
We are under a legal duty to supply goods that conform to the contract.
For UK consumers, goods must be as described, of satisfactory quality and fit for purpose where applicable.
If you receive a faulty, damaged, incorrect or misdescribed product, contact us at LCNMafiaHistory@gmail.com.
Please see our Refund Policy for further information about remedies and returns.
Nothing in these Terms excludes or limits rights or remedies provided to you by consumer law.
13. Intellectual property
The website, branding, original text, graphics, layouts and original designs created by or for LCNMafiaHistory may be protected by copyright, trade mark and other intellectual property laws.
Some products or content may incorporate historical material, licensed material, public-domain material or other content that is not owned exclusively by LCNMafiaHistory. Nothing in these Terms claims ownership of third-party rights or public-domain material that we do not own.
You may use the website for your own lawful personal use. You must not reproduce or commercially exploit our original protected website content or original designs without permission, except where permitted by law.
14. Customer-supplied personalisation content
If you provide an image, photograph, text, name, logo or other material for personalisation, you confirm that you have the right to provide and use that material for the purpose requested.
You must not knowingly submit material that is unlawful or that infringes another person's copyright, trade mark, privacy or other rights.
You grant us and our fulfilment providers permission to use customer-supplied material only to the extent reasonably necessary to process, manufacture, fulfil and support your order.
We may refuse or cancel an order if we reasonably believe that customer-supplied material cannot lawfully be reproduced. If we cancel an order on that basis, any refund due will be handled in accordance with applicable law.
15. Acceptable use of the website
You must not use our website:
- For an unlawful or fraudulent purpose.
- To interfere with the security or normal operation of the website.
- To introduce malicious software or harmful code.
- To obtain unauthorised access to accounts, systems or data.
- To infringe the rights of another person.
We may restrict access to the website where reasonably necessary to protect the store, customers or other users.
16. Third-party services
Our store is hosted by Shopify and we use third-party service providers, including Printify and its production partners, to help operate the store and fulfil orders.
We may also use third parties for payment processing, delivery, analytics and other services.
The use of third-party providers does not remove any responsibility that we have to you under applicable consumer law.
17. Third-party links
Our website may contain links to third-party websites or services.
We are not responsible for the content or practices of third-party websites that we do not operate. You should review the terms and privacy information of a third-party website before using it.
18. Privacy
Our collection and use of personal information is explained in our Privacy Policy, available at /policies/privacy-policy.
Personal information may also be processed by service providers such as Shopify, Printify, payment providers and delivery providers where necessary to operate the store and fulfil orders.
19. Our responsibility to you
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability relating to faulty or misdescribed goods where such liability cannot legally be excluded.
If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, subject to applicable law.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed, except where the law provides otherwise.
If you are purchasing as a consumer, these Terms do not exclude or restrict any liability or remedy that consumer law says cannot be excluded or restricted.
20. Events outside our reasonable control
We are not responsible for a failure or delay caused by circumstances outside our reasonable control where the law permits this.
Such circumstances may include severe weather, transport disruption, industrial action, customs delays, failures affecting third-party networks or infrastructure, natural disasters or other comparable events.
Where such an event materially affects an order, we will take reasonable steps to minimise the effect, keep you informed where appropriate, and provide any cancellation, refund or other remedy required by law.
21. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes to our business, products, services or legal requirements.
The Terms that apply to your purchase will generally be those in force when the relevant contract is made. We will not use later changes to remove contractual or statutory rights that already apply to an existing order.
22. Severability
If a court or other competent authority decides that part of these Terms is unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
23. Governing law and disputes
These Terms are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom or another country, you may also have the benefit of mandatory consumer protections provided by the law that applies where you live, where those protections cannot legally be excluded.
Nothing in these Terms removes any right you may have under applicable law to bring proceedings in a court that has jurisdiction over your consumer claim.
If you have a complaint, please contact us first so that we can try to resolve it.
